Terms of Service

Swipe a Need LLC
Where things stand today. Swipe a Need is preparing for its first App Store release. The app is not yet available in the app stores, no requests are live, and payments and payouts are not enabled. Parts of these Terms describe how the Service will work once those features are switched on. They do not mean a feature is available to you today.

1. Agreement and who we are
These Terms of Service (the “Terms”) are an agreement between you and Swipe a Need LLC (“Swipe a Need”, “we”, “us”). They govern your use of the Swipe a Need mobile app, this website and related services (the “Service”). By creating an account, giving, creating a request or otherwise using the Service, you agree to these Terms and to our Privacy Policy, Refund & Cancellation Policy and Community Guidelines. If you do not agree, do not use the Service.
2. What Swipe a Need is, and is not
- Swipe a Need is a crowdfunding platform for individuals. People (“Recipients”) share a documented bill or a self-reported everyday need, and others (“Donors”) give personal gifts toward it.
- Swipe a Need is not a charity or a nonprofit, and it is not a bank. Gifts are not tax-deductible.
- A gift buys nothing. It creates no purchase, investment, loan, ownership interest or right to goods, services, updates or repayment.
- Paying a Recipient’s bill provider directly is not available.
- Payment processing is provided by our payment provider (see section 9). We do not state or imply that any payment provider has approved or endorsed Swipe a Need.
3. Eligibility and accounts
- The Service is for people in the United States who are 18 or older.
- You can browse without an account. Saving requests and creating a request need an account. Giving without an account may be offered as a guest.
- Give accurate information, keep your sign-in secure, and tell us promptly if you think your account was used without your permission.
4. Requests
Two kinds of request. A documented bill includes a supporting document, such as a bill statement. A self-reported everyday need, such as groceries, fuel, baby supplies or household items, is described in the Recipient’s own words and is not independently verified. Showing everyday needs without a supporting document is planned and not switched on yet; today every request needs a supporting document.
Creating a request. A Recipient chooses the kind of need, adds a title, the amount and the due date, and may add a story, a photo and documents. Each request has a funding limit, and larger goals get an extra review. A Recipient may have one active request at a time.
What a Recipient must do. Give truthful information. Submit only your own genuine need. Do not submit duplicate, misleading or fraudulent requests. Cooperate with our reasonable requests for information and with any investigation.
What is shown. A public request shows the title, story, goal, due date and progress, the Recipient’s first name, their city and region if they choose, and an approved photo. A Recipient’s legal name, address, date of birth and documents are collected separately and are not shown publicly.
Your content. You keep ownership of what you submit. You give us permission to host, display and process it so we can run the Service, including showing an approved request publicly.
5. Review and verification
- Review before publication. Our team reviews requests before they are published, and publication is subject to moderation. We may decline a request, ask for more information, or remove a published request. Review does not guarantee that a request is accurate, complete or will be funded.
- Identity verification. A Recipient may create and submit a request before verifying their identity, but no payout is made until the required identity, compliance and payout checks are complete. Identity verification is planned to be done through a third-party identity provider. It is not available yet.
- What verification means. Identity verification confirms who a person is. It does not prove that a bill or a need is genuine, that an amount is owed, or how funds will be used. A document that has been provided is not the same as a document our team has reviewed.
6. Gifts
- Gifts are voluntary and personal. The smallest gift is $1.
- Swiping a request never charges you. You see the amounts and confirm before you are charged.
- You may give to one request or to several in one checkout (a “Giving Basket”). We record the amount for each Recipient.
- While you check out, your amount is held for the request for a short time so that a request cannot be overfunded.
- Donors are anonymous to Recipients by default. You may choose to be named to a Recipient. Rankings, public profiles, amounts and social links are off until you turn them on.
7. Keep What You Raise
- A Recipient keeps eligible settled gifts whether or not the goal was reached. A goal that is not met does not by itself lead to a refund, and gifts are never redirected to another request.
- Each request has a funding deadline. After it, the request closes to new gifts and a processing period of at least 24 hours follows, for settlement, reconciliation and risk checks.
8. Fees and optional tips
- There is no mandatory platform fee.
- Under our current model, supporters are not charged a separate payment-processing fee.
- Applicable processing costs charged by our payment provider are borne by Recipients and may reduce the amount paid out. The amounts will be disclosed before the relevant transactions.
- A Donor may add an optional tip. It starts at $0, is shown separately, and goes to Swipe a Need, not to the Recipient.
9. Payments and our payment provider
- Card payments are intended to be processed by Stripe. Card details are entered with the payment provider, and we do not store full card numbers. Payments are not enabled today.
- To receive payouts, a Recipient will need to complete the payment provider’s onboarding and accept its terms that apply to payout recipients.
- Payments and payouts depend on our payment provider. They may be unavailable, delayed, limited or stopped if the provider requires it, or for legal or risk reasons, and some payment methods may not be available for crowdfunding.
10. Payouts
A payout can be made only when all of these are true: the funding deadline and processing period have passed; the Recipient’s identity, payout details and compliance checks are complete; no dispute, open review, hold or suspension applies; and two different members of our team have approved it. Payouts are intended to go to the Recipient’s verified bank account. We may delay, hold or cancel a payout, or remove a request, for risk, legal or policy reasons. We do not give tax advice.
11. Refunds
- Our Refund & Cancellation Policy is the authoritative reference for when contributions and optional tips may be refunded or canceled. If these Terms or any other page summarize refunds differently, that policy controls.
- Refunds are reviewed one by one, and none is automatic.
- A goal not being met is not, by itself, a reason for a refund.
- If a Recipient fails required verification and contributions cannot be disbursed, we will arrange refunds of the affected contributions, subject to applicable law and payment-provider capabilities. We do not promise that this happens automatically.
- If a Recipient withdraws a request, or our team removes, suspends or finds it ineligible, before funds are disbursed, we review case by case whether its contributions should be refunded. A withdrawal or a removal does not, by itself, entitle anyone to a refund, and we do not promise one.
- Funds already paid out to a Recipient: we do not promise a refund or the recovery of those funds.
- If a contribution is fully refunded, its associated optional tip will also be refunded, subject to applicable law and payment-provider requirements.
- To ask for a refund, email support@swipeaneed.com with your receipt reference.
12. Disputes and chargebacks
If something is wrong with a gift, please contact us first; it is usually faster than a card dispute. If a card dispute is filed, we respond through our payment provider. While a dispute is open on a payment, that payment is neither refunded nor paid out.
13. Community features
Giving challenges, leaderboards, badges and public profiles are optional and private until you choose. Our Community Guidelines apply. We do not verify that a social link belongs to the person who shared it.
14. Reports, moderation and removal
Signed-in users can report a request. We may review reports, remove requests, remove content, and suspend or close accounts, including where we believe these Terms or the law have been broken or to protect people.
15. Prohibited conduct
Do not: commit fraud or misrepresent a need, a document or your identity; impersonate anyone; create duplicate or sham requests; use the Service to move money between related accounts or to launder money; break the law; harass or threaten anyone; interfere with the Service or its security; or try to access other people’s information.
16. Ending your account
You can stop using the Service at any time. Account deletion is started in the app (Settings → Delete account) and begins a 14-day period in which you can cancel. It cannot start while a request has gifts or a payment or payout is in progress. Records we must keep for financial and legal reasons are retained. The app is not yet available and this flow is still being tested. See our Privacy Policy for details.
17. No guarantees
We cannot guarantee that any statement in a request is accurate, that any request will be funded, or how a Recipient will use gifts. Reviews and identity checks reduce risk but cannot remove it. The Service is provided as available and may change, be interrupted or be unavailable.
18. Changes to the Service and these Terms
We may change the Service, for example when payments, identity verification or notifications are switched on. We may update these Terms. We will post the updated Terms here with a new effective date. If you keep using the Service after the new Terms take effect, you accept them. If you do not agree, stop using the Service.
